UNC BOT Chairman Perry: Carolina North “…before it’s too late”

They say history has a way of repeating itself.

The trustees, led by new chairman and Chapel Hill developer Roger Perry, are full steam ahead on the project. Final trustee approval is expected in September, with a plan to be submitted to the town by the end of October.

“The time of talking about Carolina North is over,” Perry said. “It is time to do something. It is time to get it on the ground before it is too late.”

No more “time for talking”. Does that mean that the July 31st Carolina North community outreach meeting is just for show?

As some of you know, I try to attend many of the local meetings that influence public policy. To date, I’ve been to most every Carolina North community outreach stretching back to 2005. I attended several of the UNC-LAC meetings and have watched those and the ones I missed. Arguably, UNC’s BOT meetings are as important to setting local policy – a shame that they don’t release a video or audio record of their deliberations.

I have had an opportunity to hear a little bit more about this morning’s BOT meeting and it seems that the N&O missed a little nuance.

It appears Roger Perry was asking the UNC staff to stop talking and start moving. I don’t know if that makes much of a difference in how that negatively affects community input – same effect, twice removed – but at least it is more polite than telling the community to shut up and go away.

Again, I wish I could’ve attended to hear the BOT for myself. I wish UNC would make a timely online record – including publishing minutes – available so folks like myself don’t have to wade through others interpretations.

Two years ago, when I proposed a framework for a more collaborative process between UNC and our community to work through Carolina North’s issues, several local political insiders told me I was naive and acting the fool.

Sure, I knew the history of our Town’s interactions with the University – that any discussion would have to involve five distinct parties – our local elected leadership, UNC’s Moeser administration, UNC’s Board of Trustees, local activists and Carolina North’s promoters. No doubt, that’s a lot of folks to corral.

A few months after the 2005 election, UNC did create a new framework – the UNC Leadership Advisory Committee (UNC LAC) – comprised of many, not all, of the community elements I had proposed. At that time I threw what little political capital I had behind the new UNC LAC process calling on our elected leadership to leave history behind and begin anew.

Enthusiasm didn’t equal abandonment of common sense. I was quick to point out (“Chafing: Prevention and Treatment”) when UNC started to fall back on old habits.

One of those old habits was UNC’s Board of Trustees proclivity derailing, at the last minute, the careful negotiations between UNC’s administration and our local governments.

Over the last year, the BOT did show a few symptoms of using the LAC process more as a public relations smokescreen than a new start on a truly collaborative process. For instance, when they introduced a surprising and disappointing fixed timeline before the LAC had completed their primary discussions.

Concern about the BOT was not limited to those longtime citizen watchdogs who have been participating in UNC’s new community outreach process. Jack Evans, UNC’s leader on Carolina North, has expressed his frustration with the BOT commenting one time that the Board wasn’t interested in reading a 15 page summary of the projects guiding principles.

UNC’s Board of Trustees was definitely a wild-card but the inclusion of BOT member Roger Perry was supposed to make sure there would be no surprises.

Then again, Roger Perry has tried to shut down discussion before, as I noted last September after this HeraldSun 09/27/06 report

UNC trustee and local developer Roger Perry said his sense was that UW-Madison officials essentially tell the community that the university’s mission requires it to do a certain project, and then everyone goes to work on preventing negative impacts, without trying to stop the project in general.

He said he’d like to get to that point in Chapel Hill, and that it can be somewhat “insulting” when someone not connected to UNC says they really aren’t convinced the university needs to do what it says it needs to do.

I said then

Roger Perry and the rest of UNC’s Board of Trustees absolutely must address the glaring absence of any reasonable, documented, calculable return on investment before I, a single North Carolina citizen taxpayer, will be convinced of the soundness of their plans.

So, as of today, UNC has approved a building design without producing solid documentation on the taxpaying publics return on their investment. We have a firm start date but little firm understanding of the local fiscal, environmental and transit impacts.

And, as some suspected, we have evidence that UNC’s Board of Trustees are not, possibly never were, interested in working through these key issues with community participation.

Carolina North, when fully developed, will rival today’s Hillsborough in size. I believe it will loom larger in environmental, social and economic terms.

Finally, as far as Roger, from what I’ve observed he is a patient man. Developers often are. If he’s frustrated with the pace, well, that’s forgivable. To use his new role to make haste, though, to an endpoint yet determined, well, that is neither prudent or supportable.

I plan to discuss some of the comments in a future post but couldn’t pass up this request by Rev. Robert Campbell (who, thankfully, has recently joined that forum to bring his 34 years of Rogers Road experience to the local ‘blog-o-spheres attention).

As this recent Carrboro Citizen article (” Be it further resolved”) by Taylor Sisk reveals, Rev. Campbell is neither a stranger to the Rogers Road community

The sanctuary of the Faith Tabernacle Oasis of Love Church is certainly no refuge for Robert Campbell. Outreach is his calling. For 34 years, Rev. Campbell has been ministering to the needs of a finely knit community on and around Rogers Road of, as Campbell observes, “many faces, many skills.”

Campbell quickly became active in the community. He recalls that things “really escalated in the latter part of the ‘80s, right on into the middle part of the ‘90s, when they really began to start searching for another place to put a landfill, and we spent countless hours negotiating with the politicians—right here in this sanctuary. We had it set up where you had community members that were part of a fact-finding group that came up with ideas, that came up with things that the neighborhood wanted done.”

Tonight, responding to a series of comments, Rev. Campbell provided some context and then suggested how the Chapel Hill/Carrboro community can pitch in to help their neighbors (Rev. Campbell is new to this, I edited his comments slightly for clarity):

We do many things out on Rogers Road promoting the good will of this community. We do not sit back and do nothing.

The good neighbor program has not worked for this part of Chapel Hill. Rather all government agents have over looked this area when it comes to enhancement. Took pave roads some twenty plus years to come to this community. Municipal water – I will go as far as to say the municipality dropped the ball when Robert’s Assocation did the first development in this community.

Someone looked the other way – no water, no sewage, no sidewalks, no real insight for the future. And we are still making excuses. Let us do the right thing now. Let us help make Orange County a better place.

We are to be our brother keeper. Let us look one another in deed, let us be doers of the word and not just hearers and talkers. Let us work together.

Election 2007: Update on Early Voting On The Move

Following up on my post “Election 2007: Early Voting on the Move”, BOE Director Barry Garner responded with lightning speed to my request for further information:

Nothing has been decided yet however the Seymour Senior Center is an option. The board will meet on August 7, 2007 to discuss this. UNC has offered us the student union to hold one-stop early voting but my board was split on the decision at the last meeting. Since the last meeting, we have two new board members so I will have to present to options to them again.

I do not think I can justify the cost of having two sites in Chapel Hill for the municipal election. It is not our goal to undercut the GOTV efforts, however we must find a place that is accessible to all citizens of Orange County.

Due to our current voting equipment, we are unable to have super precincts. Our voting equipment PCMCIA cards can only hold 10 ballot styles and 10 precincts therefore we cannot hold super precincts until the technology is updated.

Encouraging news on the early voting front. A bit disappointing on the super-precinct issue.

Last year I went to Hillsborough to evaluate, from both the technical and “small d” democracy angles, the new models of voting equipment our county was thinking of buying (“May 2nd: Don’t Fear the Reaper, Get Out and Vote”).

I sketched out the composition of precincts in Chapel Hill/Carrboro to the salesman. Would their optical scan equipment would support a super-precinct covering those precincts? No problem, he said.

Maybe we needed to buy the super-deluxe package? In any case, I’ve offered to provide some rabble rousing to get the necessary funds to upgrade the equipment to support a super-precinct for UNC students. Not Just Real-Estate: Chapel Hill’s Economic Strategy “Chained” Down?

Town information officer Catherine Lazorko opened up the flood gates today not only quickly responding to my request for the draft economic strategy report (Not Just Real-Estate: Chapel Hill’s Draft Economic Development Report) but this follow-up report on the meeting with the Council sub-committee on economic development.

The Council Committee on Economic Development met with the town manager and economic development officer to discuss existing goals and the proposed economic development strategy and objectives for Chapel Hill. Attending committee members were Mayor pro tem Bill Strom, Council Members Mark Kleinschmidt, Ed Harrison, and Jim Ward. Staff members present were Town Manager Roger Stancil and Economic Development Officer Dwight Bassett.

I presented copies of economic development strategies from other communities relevant to Chapel Hill. The plans included Clemson, SC (college town); Austin, TX (sustainability); Blacktown, Australia (general framework); and Toronto, Ontario (focused quality and knowledge economy).

Having familiarized myself with the Town’s current planning documents, I have concluded that there is need for a framed retail market analysis which shows leakage, weaknesses and regional market gaps in terms of population centers. Discussion centered on this need and how this can be accomplished without creating a new demand for retail development by national chains, and how we might frame this for local business development.

I presented the Committee members current goals for economic development from the Comprehensive Plan and other documents as well as a draft of an Economic Development Strategy Statement and proposed goals. Committee members requested that these goals should include wording about being proactive, nurturing development, green development, sustainability, diversity, and locally-owned businesses.

Questions were raised about how the Town can help create more opportunities for locally-owned businesses. I suggested adding that to the market study, or creating an additional study through the Small Business and Technology Development Center in conjunction with UNC. There are barriers to developing local businesses which need to be identified and overcome.
The Committee requested that I give information about the boundaries of economic development at a future meeting so that priorities could be discussed.

The Committee plans to meet again at the end of August to begin finalizing this Statement and Objectives.

The discussion of national chains is what must’ve prompted Councilmember Mark Kleinschmidt’s “involuntary scowl” (H-S).

Isn’t Trader Joes a national chain? Folks round Chapel Hill are going nuts waiting for their new Eastgate location to open.

Not Just Real-Estate: Chapel Hill’s Draft Economic Development Report

For several years I’ve called on the Town to hire a professional economic adviser. When I renewed the call during my 2005 campaign, many of the other candidates adopted (or co-opted) the idea.

I suggested we hire someone with experience in developing an economic strategy that encompassed more than Downtown redevelopment or saw economic benefits beyond those derived from commercial and residential real-estate.

For many years our Town’s elected folks ignored policies that would encourage job, entrepreneurial business and cottage industry growth. Their lens, if focused at all, stayed firmly on traditional areas. Worse, they continued some policies – like the business privilege tax – that actually act as a disincentive.

I was somewhat worried when we once again hired a former consultant from Town manager Roger Stancil’s past. With the hiring of Dwight Bassett (Two Years Later Town Hires Economic Development Officer), we at least had filled this important position. Dwight’s background had been mainly focused on Downtown redevelopment projects and developing other traditional avenues of economic activity.

I was concerned then, and still am, that we will miss out on using our Town’s unique pool of talent to develop our economic strength using a new paradigm. For instance, leveraging our commitment to deploy a municipal network to attract low environmental impact, highly distributed employment opportunities paying better than average salaries.

This week we get our first glimpse of Dwight’s thinking in the following DRAFT report. Today’s Herald-Sun has this to say:

Bassett also passed around economic development strategy statements crafted by officials in Austin, Tex., Clemson, S.C., Toronto and a town in Australia that represent different approaches to planning. The resulting exchange of ideas demonstrated that Bassett’s collaboration with town officials will need some time to gel.

While he and the committee agreed that several areas of the town could be better developed to maximize business and slow “leakage” of retail traffic to other municipalities, Kleinschmidt’s face crinkled into an involuntary scowl when Bassett introduced the concept of a “lifestyle center” such as a mall or big box outlet that could single-handedly draw business to an area.

The committee also discussed potential targets for a retail makeover, including University Mall, Eastgate Shopping Center, downtown’s West End and the interchange of I-40 and Martin Luther King Jr. Boulevard.

Kleinschmidt agreed that leakage must be stopped, but added, “KFCs and Wachovias … that can’t be it. That can’t be right.”

The committee agreed, however, on the basic point that a market analysis is needed to determine the best course for developing Chapel Hill’s economy.

Hey, is that the same market analysis I called on 4 years ago? Hey, at least the Council is starting to get around to it.

Jacobs to Strom: The Homeless Shelter Remains A Spasm in Chapel Hill’s Lower Back-side

“The communication between the two governments within the same community has been spasmodic and not effective.”

— Orange County Commissioner Barry Jacobs after Chapel Hill Town Council member Bill Strom criticized the county this week for not working more closely with the town on finding new locations for a children’s museum, men’s homeless shelter and District Court.

Bill kind of rattled on, as you can see [Granicus WMV], about the lack of coordination between the Town and the County – notably, in this case, working to re-site the Men’s Homeless Shelter.

What could’ve Bill done over his last eight years to make sure we don’t “spin our wheels” with the Orange County Board of Commissioners when the Town needs their help? Or that Council doesn’t end up with the BOCC using their “75 years” of collective political experience to “bury us 25 feet under in process and procedure” when we call for assistance?

His complaints about “burying” folks under “25 years of procedural manipulation” is ironic given Mayor Pro Tem Strom’s shelving of a request for real accountability on the Lot $$$5 development project.

Given the sad state of communications and cooperation between this Council and our current Board of Commissioners, Bill is right to call upon the Town and our Town Manager to create a Plan B for the Men’s Shelter’s relocation.

Eight, maybe ten years into the discussion, the BOCC continues to reject Homestead Road’s Southern Human Services Center as a viable location and we still don’t know where to site this necessary shelter. Yes, maybe we can wedge in a facility at the Town’s new Operation Center but, at least to me, that begins to verge on “warehousing” these folks out-of-sight in lieu of attacking the underlying problem head on.

By the way, Bill might have been a little testy because it was late and I had just reminded him that his grand obsession with the white elephant that is the Downtown Development Initiative’s Lot $$$5 project was going to hurt our community in order to bolster RAM Development’s bottom-line.

Whatever the reason, he’s had eight years to improve the lines of communications. I’ll be interested to hear how he proposes to improve the situation if he’s given another 4 years on Council.

Democrats No Longer

I’m a registered Independent.

OK, OK. I know there is no such thing as an Independent designation, just unaffiliated.

Unaffiliated. Indecisive. Indifferent. Uncommitted. Uninvolved. Fence-sitter. Don’t care.

A truly perverse bit of political framing.

I hope my occasional contributions to the local debate (CitizenWill , OrangePolitics, SqueezeThePulp, the Daily Tar Heel, the Chapel Hill News) and my willingness to take principled, though sometimes unpopular, stands on local issues demonstrates a small measure of care and commitment.

For years I’ve worked to elect Democrats. Dropped a few bucks here and there for a few of their more worthwhile national candidates. Sat polls for the local Orange County party. Contributed oodles of time to their and other affiliated organizations’ efforts to Get Out The Vote (GOTV). No plans to stop those efforts anytime soon.

But I am no Democrat (I was once). And I am no Republican (never have, never will be).

Heck, don’t try to graph my position on the one dimensional line passing through the Democrats Right to Republicans…. I, like many other local folks, exist outside these parties calculus.

I don’t know why three folks chose this week, from the many other recent weeks of Democratic disappointment, to ask me how to switch their party affiliation.

Maybe it was the recent reversal on Iraq or just the steady dissipation of last November’s promise.

Why me? I’m certainly not trying to “recruit” Independents. Sure, I haven’t been reserved in expressing my dissatisfaction with our local Democrat US Representative. They each knew of my efforts to open the local political scene to Independents via non-partisan elections and other voting reforms.

And I’ve been quite open about my status.

When, during my 2005 run for Town Council, a few local political operators counseled quiet discretion – suggesting talk of my non-affiliation would lead to a loss of stalwart Dem votes – I countered that to do so would not only be against my own tenets but promulgate the ruinous myth that folks are only capable of selecting representatives that fall along a one-dimensional political axis.

They might’ve been right. I did lose.

There is safety in numbers. Yet change springs from the outliers. And in today’s United States, it isn’t too far from “united we stand, divided we fall” to “deru kugi wa utareru”.

If you would like to lose your affiliation, either Republican or Democrat, or register to vote under any flag, the procedure is easy:

    If you wish to change your party affiliation, you must complete either a Voter Registration Application Form (downloaded from address above) or complete the reverse side of a Voter Registration Card that has been mailed to you and return to the Board of Elections. All changes must be either postmarked or received in the Board of Election’s office at least 25 days before the election.

  • Emancipate yourself from either of the two currently recognized parties.

Scared? You don’t have to go totally “cold turkey”. You will still be able to play some of the old game, for instance voting in either party’s primary. Initially, in many ways both large and small, you’ll feel stuck on the sidelines – constrained to vote for choices you wouldn’t have made, for flavors as close as Pepsi to Coke.

At first you might feel a little light-headed drifting above our current political Flatland. Navigating the multi-dimensional political reality we all currently occupy, whether we appreciate it or not, without the constant tether of partisan loyalty is heady stuff. Don’t panic! After a while, the relief of free agency sets in.

Still, though shorn of your party’s old baggage, paralyzed by its intransigence no longer, you leave one burden for another.

Sorry. Independence doesn’t mean “indecisive”. It doesn’t mean “uncommitted” And it certainly doesn’t mean “don’t care”.

Carolina North: Location! Location! Relocation?

If there was a theme to yesterday’s third community outreach on UNC’s Carolina North project it was “more of the same”. Same dearth of detail. Same soft sell of the economic benefits. Same back “peddling” (as in wheeling-n-dealing) on their functional commitments.

UNC Chancellor Moeser’s “quarterback”, Jack Evans, presented the major recalibration of Carolina North’s raison d’etre as a small side note during the revelation of the first increment of development.

According to Evans, the new plan projects that half the 2,550,000 million sq./ft. of development being done over the next 15 years will house extant initiatives already located on main campus, other UNC properties or rented facilities.

Prior to yesterday, Carolina North was touted as a catalyst for new jobs (“UNC-CH has plans for a state-of-the-art research campus that would bring as many as 20,000 new jobs to Chapel Hill over the next 50 years.” UNC seeks $25 million to start Carolina North N&O Nov. 16th, 2006).

Now, as far as employment, Carolina North has become a convenient place to site their currently dispersed workforce. Having said that, Evans cautioned that the balance between academic and economic development might change dramatically over time – tilting more towards academics as the necessity for moving folks off main campus increases.

In other words, Carolina North has morphed from Chancellor Moeser’s “catalyst for the economic transformation of our state” to what is really an overflow campus….

Orange County’s White Vote

OK, before folks freak out, I have gotten to know the staff at the Orange County Board of Elections fairly well over the last 5 years. They’re friendly, professional and have always gone the extra mile to clarify issues/fix problems. I’m fairly sure they had no hand in the selection of this, ummmm, very white image to welcome all of Orange County’s voters to their site.

Orange County has recently spiffed up their website, making it more difficult to navigate by some folks estimation (besides making it more difficult to find contact info, having used the old site extensively for general research, I concur).

I’m sure the pictured family are fine upstanding citizens raring to vote. I’m also pretty sure I could find local analogues (maybe even doppelgangers) living right around the corner. Still, for a department interested in encouraging the greatest participation, the drama implicit in the image is rather interesting.

No Comment: The Mayor Turns Away the Public

For going on two years I’ve worked with the stalwart defenders of the Lincoln Arts Center.

The long-time, self-supporting hands-on Chapel Hill ceramics arts program is poised to die. Decades spent by staff and students alike building a strong community. Fostering creativity in the young, old, rich, poor, infirm and not. Gone because more than two years is too short for our leadership to act.

Continuity, it appears, be damned.

Incredible irony for a Town bent on satisfying a lust for arts consumption (upping developer contributions to purchasing art to %2).

This isn’t about the lone program that has kept the flame of recreational arts production alive. This is about furthering a commitment to assist the growth of our residents – body and mind. This year’s budget has $2.7+ million allocated for body, none, as of two weeks ago, for preserving this program squarely aimed at expanding the artistic mind.

An incredible shame given how long, years and years in this case, the Town has known about that tickling clock. The sands have nearly run out for this venerable, popular program. The school system has asked it to vacate Lincoln Center.

The roads must roll – the program must move or perish.

Earlier last week (Tuesday), the group met to draft a response to an April 23rd agenda item covering staff’s response to our previous petition to save the program.

These citizens pulled together their critique of the two small and unsuitable spaces. Firmed up, once again, the costs ($25-40K) of making the Community Park’s Plant Road garage a great space for ceramics. Spoke of how saving this program should serve as a catalyst for more investment in hands-on arts programs. Gathered speakers to respond – in detail – to the rather insubstantial effort the current interim head of Parks and Recreations’ so far has proffered.

Then, sometime after, the online agenda changed. Staff would now respond May 7th.

Considering the very, very, very short time left to budget and plan for the programs continuity (roughly 60 days), these supporters decided to appear before Council anyway on April 23rd to share their research and concerns.

I contacted the Town Manager’s office to make sure they knew these folks were on the way – no problem.

Our five speakers gathered this evening to find out the Mayor would not allow them to speak on this issue.

No comment allowed, even during the 3 minutes every one – citizen and not – has traditionally had to air any issues whether they’re on the agenda or not.

In all the years I’ve participated in Town politics, I don’t recall anyone, even some North Raleigh visitors upset with the way our Town won’t discriminate against folks, not being allowed to use their 3 minutes before Council.

The Town had notice these Lincoln Center activists would appear. the Mayor knows a timely resolution is necessary – that we’ve come to those last critical weeks before the budget is finalized – that circumstances are threatening to overwhelm any desire they may have to save the program. It was “Sorry, no comment.”

The group took their dismissal in stride – in good spirits prepared to return May 7th.

They’ll be back then present their research and concerns to the Mayor and Council. To me, it’s another two weeks gone in a process dragging on more than two years. Another two weeks staff fails to tap into the creativity of our citizenry. Another two weeks for a poor result to be set in the bureaucratic concrete.

Sorry guys, to me, the dismissal is an uncalled usurpation of the citizen’s right to redress – an uncharacteristic and unfortunate turn of events for a Council that’s so far held to the great Chapel Hill tradition of letting folks say their piece.

I’m afraid they’re not quite setup to take questions. I spoke with Christy Dixon who is working the problem. This is a great opportunity to get direct responses from some of our key local leaders – I hope folks are willing to slog through and call to comment.

Trash Talk: I Like Vinegar on My BBQ

The old Southern saying goes “You can catch more flies with honey than with vinegar.”

Then again, there’s nothing like a little vinegar or Tabasco to cut though the cloying fat of smoked BBQ.

An open e:mail to the Orange County Board of Commissioners:

On Tuesday evening, at the Orange County BOC meeting in Hillsborough it became glaringly apparent there was a complete failure of do diligence in the Waste Transfer Station site selection process. In fact there was no real process at all. Chairman Carey, 2 years of talking is not a process, it was just 2 years of talking and no basis for a decision.

Unfortunately if this failure is allowed to stand the people who will most directly carry the consequences and burden will be the working class African American community on Rogers Road, the same people who have carried the burden of the county’s landfill for 34 years. There is absolutely no way to deny that this failure to act professionally is in itself an act of environmental injustice. There is much irony in that Orange County is considered the most progressive county in North Carolina, and home to Senator Edwards and his Presidential Campaign which is centered around helping the “Other America”.

My anger was apparent at the meeting and still apparent in this e-mail, I make no apologies. I am not a politician or a policy wonk. Nor do I make a pretense of tactful persuasion. My wife’s parents lived their lives in north central Philadelphia and were 50 plus year members of the Zion Baptist Church which was led for many years my the late Reverend Leon Sullivan. When visiting my in-laws they would bring us to the church even though I am not a Christian. Listening to Reverend Sullivan was always an education and an inspiration. In my early twenties I remember Reverend Sullivan talking about personal integrity and professional integrity and that both were tied hand in hand. He told us that we can not claim to have one without the other. He was relating this concept from his involvement with American and international business executives and political leaders.

It became obvious in Tuesday’s meeting that the Waste Transfer siting process had , no professional integrity, no intellectual integrity, no moral or ethical integrity and formed no solid basis for any decision. Chairman Cary, in your e-mail response of 2/17/07 to my request of all the leaders of this community to take as stand on this issue, you said to quote:

“… it would be premature and unethical in my opinion for any elected official to respond to you as you have requested prior to considering all information which must be considered to make an informed decision on this matter.”

With all due respect, by calling for a vote on this issue on Tuesday you were violating your own stated ethical standard. It is clear The Orange County BOC nor anyone else for that matter has all the facts needed to make an informed decision. It is now in the open that the Orange County BOC has never directed anyone or any group to get all the facts.

It is also misleading that the BOC can only start “mitigation talks” to compensate the Rogers Road community after a site is chosen. The Rogers Road community has already earned that compensation through their 34 years of sacrifice. Why should they have to acquiesce to a Waste Transfer Station to receive compensation? Discussions can start whenever the BOC decides to do so.

It was also clear that Commissioner Foushee, Commissioner Jacobs and Commissioner Gordon were struggling with what they witnessed Tuesday night. Commissioner Foushee was the first to speak with eloquence and concern, articulating her distress on the deficiencies of the process to date. She expressed the desire to get this right. If an academic study were to be conducted on the right and wrong ways to site a waste facility as things currently stand Greensboro would be the case study of the right way and Orange County would be the contrasting case study on how get it all wrong. I am asking all the commissioners: Are you proud of where we are on this issue? Are you proud of how we got here? Is this an example of good governance?

If each of you abide the principle of tying personal and professional integrity together then you have no choice but to vote against siting the Waste Transfer Station on Eubanks Road. You have no choice but to restart the siting process.

I published David’s earlier correspondence with Commissioner Moses Carey highlighting the lack of a systematic approach in selecting a waste transfer site. Since then, even knowing of this troubling deficit, Carey pushed for an immediate vote to solidify the choice of the Eubanks Road site.

But some sense prevailed during last week’s Orange County Board of Commissioner’s meeting as the other BOCC members responded to both the illogic of the current situation and to the many folks that showed up to ask for more prudence. They directed staff not only to do a more exhaustive evaluation but to incorporate a more multi-dimensional approach like the one I’ve previously suggested.

I’ve heard a few comments from folks that David is coming on a little too strong. I understand his passion.

The calculated lack of process was destined to produce one answer – an answer BOCC member Carey is obviously comfortable with – an answer extending the 34 years of ills the Rogers Road community has borne by decades.

That deficit is so glaring, the troubling consequences to the Rogers Road community so apparent, it is an injustice crying for redress.

And when the redress comes slowly, grudgingly, even a bit bitterly from our elected folk, well, a little bit of vinegar is quite excusable.

Landfill Gas

Wilson states that we are going to initiate a further study to examine two options for possible utilization of the landfill gas. One is to work with the University to determine if it is feasible [for use of the gas by the University] and if so what the economics would be of piping actual gas to Chapel Hill North. It’s probably not worth it if they’re not going to build anything there for six or seven years (as they will miss gas production peak). The other alternative is to consider providing energy for a cluster of government buildings on Eubanks Road, which would be the Animal Shelter, the Operations Center, possible transfer station and a school. In two to three months we’ll have that report and know if it’s a go or not. Economically an option with the University would make more sense and be less costly. They won’t have to worry about generating electricity, putting it on the grid, negotiating with Duke Power; they would clean up the gas a little and pipe it directly to a UNC boiler.

Sassaman asks what will be required for the collection system.

Spire states that [it will require] the wells, piping it altogether to a main header and depending how much it will have to be cleaned up, compressed and used to run a micro turbine or if we can clean it up less and put it in a pipeline to the University.

Wilson notes the industry is moving towards micro turbines and away from internal combustion engines which are noisier and tend to produce more emissions.

Smith asks what does a “well” look like?

Spire replies that a well is a hole dug into the trash that a PVC pipe is stuck into to draw the gas into using a vacuum pump. The wells are 18 to 24 inches in diameter. You can put a lot in and put lateral pipes to connect to vertical headers.

Wilson notes its likely gas will be extracted only from the south side, not the north side.

Spire notes that Greensboro’s landfill is already producing gas.

Norwood asks if there is anyway to gather information about the dangers of the installation?

Wilson states that it’s dangerous with a small “d”. It’s not like it is going to blow up 20 or 30 acres. It’s dangerous if you don’t know what you are doing. It’s possible that someone right next to the extraction point might be killed, but I don’t think it’s dangerous to the neighborhood.

Sassaman notes that this is not high-pressure pipeline gas. It is low-grade gas with moisture, CO2, other contaminants.

Pollock notes that the gas company does not want this gas in their pipeline.

From August 3, 2006 SWAB minutes:

Landfill Gas Study

Wilson states that the consultant is tentatively scheduled for the September 12th [BOCC] meeting to make a presentation on one half of the study that they are doing. They have been asked to do a study on providing energy for county facilities on Eubanks Road, which will potentially include a school, a new animal shelter, our operations center and possibly a transfer station. That part is done and will be presented at a future meeting. The other half of the study is to evaluate the feasibility of providing energy pipe line gas to Carolina North, the University facility. We have been instructed that before that study is done to meet with the University. We are in the process of setting up the meeting with the University.

Sassaman asks if the SWAB will get a chance to look at the study before it is presented on the 12th.
Wilson states that you are welcome to see the report.

From the minutes of September 7th, 2006:

Landfill Gas Study

Wilson states that there is a landfill gas feasibility study looking at two potential possibilities. One is utilizing landfill gas to provide energy to a complex of local government facilities on Eubanks Road. That part of the study is complete.

The other option is providing energy to the University for their Chapel Hill North facility. That part of the study is underway. That report should be ready for the Commissioners in another month or so and will be shared with you all. The next step is once the report is complete the Commissioners will indicate a preference for one or the other and then the next step of more evaluation and measurement will happen.

Pollock asks if there will be consideration of making electricity but everything to be direct fire.

Wilson states that the University option is essentially cleaning up the gas and piping it directly to them. The other option has sub-options but is generating electricity.

From the minutes of October 5th, 2006:

Landfill Gas Study

Wilson states that I also met with Olver today regarding this project, regarding the option to power a cluster of local government facilities including school, Animal Shelter and our new facility on Eubanks Road or piping gas or generating power for Carolina North. The effectiveness of this is determined by when they will have something on the ground. If it is six or seven years out this is not a good option as we will be going down in gas production. Generally we’re venting gas; we flare gas from one wet well as there have been some special [odor] issues at that manhole. [CitizenWill: emphasis mine]

Kabrick asks is there a draft report.

Wilson replies not at this time. There are draft spreadsheets. The consultant is going to make some changes, take that to the University staff for comments and make a final report to BOCC and UNC and the BOCC will have to decide if they want to pursue one option or the other. The UNC option is break even, [the other is worse]. We can’t take advantage of the credits that a private developer could. The whole set of credits is complicated.

Kabrick asks if you have talked to UNC about the carbon reduction program that the Town has signed up for. This will be a good way to do something with greenhouse gases.

There might’ve been additional discussion post Nov. 2006 but those minutes are not online.

Side note: Minutes of meetings are an important source of information. A delay of months, especially in a discussion as critical as the trash transfer station, is unreasonable. That said, if the county staff are as overwhelmed by the workload as Chapel Hill’s Clerk’s office, then the delay is understandable – but not forgivable.

But it isn’t the folks doing the work that need forgiveness, it is the job of our elective officials, especially those banging their chest about transparent open governance, to provide sufficient manpower and resources to get the job done.

Given that, as a frequent consumer of our public records, and someone that thinks our diligent Clerk’s office needs more help, I’ll be asking Town Council this budget season to allocate sufficient resources for the timely production and publishing of written, audio and video records.

Trash Talk: Waste Not Methane, Want Not Energy, A Few Examples

I quoted in my post Trash Talk: 1 Megawatt of Waste Not Methane, Want Not Energy… a February, 2006 GeoTimes report titled Recovering Landfill Gas for Energy. Two of the authors, Amarjit Riat and Wayne Blake-Hedges work just North of us at Virginia’s Fairfax County I-95 landfill complex [MAP & INFO]:

Riat, a professional engineer, is chief of the I-95 Landfill Complex in Fairfax County in northern Virginia, and has 20 years of experience in construction and management of sanitary landfills. Blake-Hedges is senior engineering technician for the I-95 Landfill Complex, and has 16 years of experience in construction, operation and maintenance of landfill gas systems.

What struck me about this article was the breadth of experience Fairfax County developed in implementing their land fill gas recovery system – a system first implemented 17 years ago.

The landfill gas extraction system in Fairfax County started in 1989, to keep landfill gas from migrating offsite to a neighboring prison complex (Lorton Youth Center) and for future beneficial use of the gas. The original 27 exterior passive vents were converted to extraction wells, including seven interior extraction wells. The seven interior wells were meant to serve as enrichment wells, to ensure that the gas composition had enough methane to allow the gas to be burned in an incinerating flare. On startup of this system, the flow of gas was considerably greater than anticipated, with flows averaging 700 to 900 cubic feet per minute. The county awarded a contract for landfill gas utilization to Michigan Cogeneration Systems, Inc. (Michigan Cogen), in 1990, when it began construction of its first landfill gas-to-electricity plant. The plant went online in December 1991. This first plant utilized 1,150 cubic feet per minute of landfill gas to generate 3 megawatts of electricity for direct sale to Dominion Virginia Power, the local electrical utility. The plant houses four generator units, each capable of producing 800 kilowatts of electricity. Approximately 200 kilowatts are used by the plant, leaving a 3-megawatt net output. Subsequently, the I-95 landfill began expanding its landfill gas collection system and piping to deliver gas to the new landfill gas-to-electricity plant.

Building upon their initial success, Fairfax has expanded their utilization of recovered gas and continued to upgrade their facility as recently as 2005.

In 1992, Michigan Cogen began constructing a second 3-megawatt electrical generation facility. This plant became operational in January 1993, and is essentially identical to the first plant. Like the first, it is also solely fueled by landfill gas. This system consisted of 75 additional interior landfill gas extraction wells, 22 horizontal collection trenches and collection piping.

In May 1997, Michigan Cogen began operating its third landfill gas utilization project. This facility compresses the landfill gas into 10 pounds per square inch, removes the majority of moisture and then delivers the dry gas to the Noman Cole Pollution Control Plant for use in sludge incineration. In an afterburner process, the gas cleans up the emissions from sludge incineration.

This landfill gas replaces natural gas previously purchased from Washington Gas. Instead, pipelines deliver gas directly from the I-95 landfill to the Noman Cole Pollution Control Plant. Landfill gas utilization by the pollution control plant is extremely variable and is based on the amount of sludge incinerated and the moisture contained in the sludge, but averages between 300 to 1,400 cubic feet per minute.

In March 2005, five standard natural gas infrared heaters were retrofitted and installed in the maintenance building of the I-95 landfill. These units replaced two existing propane-fired forced air heaters and tapped the existing pipeline that delivers landfill gas to the Noman Cole wastewater facility. A simple treatment system was installed to remove any remaining moisture and contamination. After treatment, the gas is delivered to the heaters through a stainless steel piping system. The radiant heaters use a maximum of 30 cubic feet per minute of landfill gas.

An interesting factoid they present is that “A 1-megawatt electric power plant working on an internal combustion gas engine needs a sustained flow of about 350 standard cubic feet per minute of landfill gas.”

As I noted before, based on SWAB member Randy Kabrick’s 500,000 cubic feet of methane being out-gassed from our “older”, less productive landfill into the atmosphere daily, our county is currently wasting at least 1 megawatt of electrical generation capacity.

Worse, methane as a greenhouse gas is considered to be more harmful than CO2.

Methane is about 21 times more powerful at warming the atmosphere than carbon dioxide (CO2) by weight (see box below). Methane’s chemical lifetime in the atmosphere is approximately 12 years. Methane’s relatively short atmospheric lifetime, coupled with its potency as a greenhouse gas, makes it a candidate for mitigating global warming over the near-term (i.e., next 25 years or so).

Worse yet, the “21 times more powerful” is considered by some to be a gross underestimation as the NASA reports Methane’s Impacts on Climate Change May Be Twice Previous Estimates.

Of course, the benefits extend beyond displacing “outside the county” sources of energy and mitigating gas releases:

Using landfill gas for energy is a win-win opportunity. Landfill gas utilization projects involve citizens, nonprofit organizations, local governments and industry in sustainable community planning, and they create partnerships. These projects go hand in hand with community and corporate commitments to cleaner air, renewable energy, economic development, improved public welfare and safety, and reductions in greenhouse gas emissions.

Directly using landfill gas to offset the use of another fuel (natural gas, coal and oil) is occurring in about one-third of the currently operational projects. This direct use of landfill gas can be in a boiler, dryer, greenhouse or other thermal applications. Innovative direct uses include firing pottery and glass-blowing kilns; powering and heating greenhouses and an ice rink; and heating water for an aquaculture (fish farming) operation. Industries currently using landfill gas include auto manufacturing; food processing; pharmaceutical manufacturing; wastewater treatment; consumer electronics; and paper and steel production, just to name a few.

Generating energy through the landfill gas projects provides many environmental benefits. The projects assist in destroying methane, a potent heat-trapping gas, and offset the use of nonrenewable resources such as coal, natural gas and oil. They help reduce air pollution, and the landfill gas emitted from decomposing trash is a reliable and renewable fuel.

The benefits from the I-95 landfill project are approximately equal to any one of these: removal of emissions equivalent to 50,000 vehicles, planting 72,000 acres of forest, offsetting the use of 1,300 railcars of coal or powering 3,800 homes.

The technology is also cost-saving. The savings in fuel costs are approximately $500,000 annually from the landfill gas use at the Noman Cole Pollution Control Plant and $5,800 from use of landfill gas for heating the maintenance building at the I-95 landfill.

Trash Talk: 1 Megawatt of Waste Not Methane, Want Not Energy, April’s SWAB Report Reveals Opportunity

To flesh out my earlier post “Trash Talk: Waste Not Methane, Want Not Energy” here’s a few comments from the April 6th, 2006 Orange County Solid Waste Advisory Board (SWAB).

There’s a few inline comments demarcated by [CitizenWill:…].

Landfill Gas Preliminary Report (discussed after item 1)

Tipton [BJ Tipton – member ] states that other than what was in the newspaper I don’t know a lot about what is going on. I just wanted to get the update.

Wilson [Gayle Wilson – OC staff] states that a presentation was given at the Assembly of Government’s meeting March 30 regarding this. Back in 1997-98 an EPA representative, myself and another staff member met with UNC Energy Services officials who were in the process of designing a fourth boiler (at UNC) and that was when they decided to look at modifying the boiler to use landfill gas. The University never formally responded.

Over the years the use of landfill gas at Chapel Hill North has come up. Phil Barner of UNC facility services called at the end of October early November and stated as they were talking about Carolina North they wanted to know about using landfill gas. I explained that we had a consultant do a report and would be glad to send it to him. After the report was sent in February, I didn’t hear anymore about it until a couple of weeks ago.

Then we got a letter from Carolyn Efland at UNC about landfill gas.

Now there appears to be competing interest in landfill gas. Some of the Commissioners are interested, if it’s feasible, in powering the new Animal Shelter, a new elementary school to be developed on Eubanks Road, our Operations Center and possibly the transfer station. The University has some interest as well. We are in the process of discussing further work with our consultants to do an additional evaluation regarding each of those potential uses. We know that we have gas, but if Carolina North isn’t coming on line for another six or seven years it won’t be worth it.

There are no partners imminent, like next June.

Sassaman [Jan Sassaman – member] states that the gas would have to be used, you can’t store it.

[CitizenWill: Don’t understand this comment as the gas can be converted into methanol or liquid natural gas or propane, etc.]

Smith [Remus Smith – member] asks if the landfill was closed tomorrow how many years would it take to produce gas?

Wilson states that gas worthy of recovery – 12-15 years of time left.

Tipton states that the report talks about the flow.

Wilson states that there are two landfills. The old one on the north is down the [gas production; it started in 1972] curve. The one on the south side isn’t half way up the curve. It has some good stuff coming from it now, but it will not produce for a long period of time [because it’s small].

Kabrick [Randy Kabrick – member] asks if it is being flared now?

Wilson states that we are passively venting it. We have one flare at a central point. I have been resistant in the past because I didn’t want to scare the neighbors lighting up the landfill like a birthday cake. Now we are going to take another look at it even though we are below the regulatory threshold for recovering it.

Kabrick estimates 500,000 cubic feet a day are vented.

This article from GeoTimes points out that “A 1-megawatt electric power plant working on an internal combustion gas engine needs a sustained flow of about 350 standard cubic feet per minute of landfill gas.” So, we’re pissing away from this small, old landfill 1 MEGAWATT of electrical generation capacity.]

Wilson notes that the biggest single cost of recovery is the network of piping that must be installed and for an active landfill it’s more difficult until it’s closed.

Spire [Paul Spire – staff] notes that there is no infrastructure for recovery on the south side now at all and there are problems with putting this gas into the pipeline; the gas company doesn’t want it.

Wilson notes that [unlike Duke Power] the gas company is not required to accept landfill gas.

Tipton asks when will this group take any action on this?

Wilson states that I plan to keep you all apprised of any reports. If you all have any input it would not be out of line to make a recommendation. You will be hearing more about it in the next six months.

As I noted above, we are currently venting from the smaller, older (1972) landfill enough gas to drive a 1 megawatt electric power plant. 1 megawatt of discarded capacity seems like a profligate waste to me.

Imagine what we could do with the “newer” landfill.

Imagine if we used fuel cells with land fill gas [PDF] instead of internal combustion (more expensive upfront but the lack of nasty byproducts make it worth considering).

Imagine if we positioned our county to be more self-sufficient, reduce dependence on Duke Power’s coal-fired misery and generate some positive cash flow to boot!

Is that the Orange County we live in?
